According to a recent paper by Collins http://www.history.ucsb.edu/faculty/Collinsmaterial/books/The%20Ilemi%20Triangle.pdf, SPLM/SPLA, the rebel group that controls Southern Sudan, probably quietly ceded the territory to Kenya.
